Pedestrian wins compensation battle- 10/04/2008[top]

A pedestrian who was hurt after an out-of-control car mounted the pavement and smashed into him has won a four-year battle for compensation.

Neil Bourne, a 40-year-old from Bolton, suffered injuries to his knees and pelvis after an unoccupied Ford Orion careered through a supermarket car park after being left without the handbrake on properly, reports the Bolton News.

A protracted legal battle began in 2004 when the insurance company of the woman who owned the car refused to make a payout after the accident.

Mr Bourne told the newspaper that it was his legal team that provided the confidence to proceed with the case.

He said: "The insurance company made it so difficult that many times I was ready to give up but he [Mr Bourne's solicitor] told me that insurance companies often put obstacles in the way and encouraged me to keep going with the case."

Mr Bourne was paid an undisclosed fee after the hearing at Bolton County Court.

Meanwhile, a motoring group in Lancashire has demanded that the problems of potholes - which often lead to accidents and personal injury - on the county's highways must be addressed, after figures were released which revealed the north-west's roads contain on average 16 per mile.
