Q How can I have my bank charges refunded when those charges are published in the bank's terms and conditions? [Top]
A

The charges are unenforceable and can be recovered because they are too high.  Just because the banks say they were published and you have agreed to them does not mean they are fair!  With our expertise in legal and financial services claims we will challenge the banks' charges on your behalf. We believe we can get your unfair penalty charges refunded.

Q I have an account, which has been closed for some years now. Can the bank charges I paid still be reclaimed? [Top]

Yes. We can usually reclaim unfair bank charges for up to six years back from when you claim on any account, whether it is open or closed.

Q How do I know how much I have been overcharged? [Top]
A

This is the total of the penalties your bank has charged you, less the real cost they incurred.  In addition, where you have paid interest on those charges we may be able to recover that as well.  Part of our service is to calculate the total amount due (using the statements your bank will send us) and secure for you the best possible refund.

Q How much will I have to pay 'up front'? [Top]
A

Nothing. We will only charge you for our services when we have successfully claimed back from the bank all your excess charges from the last 6 years. If your claim is unsuccessful you will pay nothing.  However, you will have to pay your bank or card issuer £10 to cover the cost of providing the financial data relating to your account.

Q How much will it cost me? [Top]
A

Our service is results based: we operate on a no win - no fee basis.  We only get paid when you do. Please note we make no upfront charges although your bank will charge a £10 fee.
Our fee is 25% including VAT of the amount you receive subject to  a minimum fee of £50 to ensure our processing costs are covered. If your claim is unsuccessful you pay nothing.

Q How can I be sure of your integrity and that you will treat my confidential information appropriately? [Top]

We're committed to high standards of customer service and integrity; we are registered with the Information Commissioner's Office, and comply with all relevant Data Protection Laws.

Q I have already started to claim my charges back from my bank but I am worried that I might have to go to court and represent myself against my bank. Can you still help me now? [Top]
A

Yes, in most cases as long as you have not served Court papers on your Bank we may still be able to help.  We may also be able to help avoid going to court.  If you are in this position, please give us a call on 0845 271 4004.

Q I have a store card with these charges on. Can you reclaim them as well. [Top]
A

Yes. We can reclaim wrongly applied charges on any store card or credit card account.

Q Will my bank close my account if I claim back these charges? [Top]
A

Some banks have taken this stance.  However, The Banking Code Standards Board has advised Banks "to ensure that they do not make a disproportionate response to customers claiming back these 'default' fees and treat the customers sympathetically and positively in accordance with the provisions of Banking Code section 14."
 
The Financial Ombudsman Service has also criticised at least one bank for this practice, but it is unclear whether the banks will comply with this.

As a precautionary measure, we recommend that all claimants open a new bank account that can be used in the event their bank decides to take this negative approach.

We take great effort to establish a professional relationship with all the banks we deal with.  Our communication should not provide any cause for substantial break down in your relationship with your bank.

No.  As soon as we receive your completed application we will undertake all the work involved in reclaiming your charges.  Where we need information or decisions from you we will let you know.  Our aim is to make the process as simple as possible.

Q Could I make a claim on my own? [Top]
A

Yes.  There are sites such as the Financial Ombudsman Service, Which?, The Consumer Action Group and moneysaving expert.com that can help you to do this.  We would advise you to consider the following points:

· Check your bank statements thoroughly
· Check the interest you have been charged
· Know your rights
· Be prepared to engage in correspondence with your bank

Our service is designed for people who do not want or have the time to manage their claim themselves.
