Brain injury engineers' family seeks compensation- 17/07/2008[top]
The family of an air conditioning engineer who suffered brain injury after falling 2.2 metres at work is pursuing a civil claim against his employer and a second company.
Air conditioning firm Team Q, which employed Kantilal Mistry, and advertising firm Schawk UK, are facing a civil compensation claim after the two companies wree prosecuted by the Health and Safety Executive (HSE).
Mr Mistry was repairing an air conditioning unit on the roof of Schawk UK offices when he fell and fractured his skull, for which the family is seeking personal injury damages.
The HSE investigation revealed there was no easy access to the roof and unsuitable protection.
Although Team Q had previously indentified the site as "at risk" and told Schawk its assessment, no remedial action was taken and Mr Mistry was not informed of the assessment.
Mr Mistry's brother Dirjlal told H&V News: "My brother spent over a month in hospital, which shows just how bad his accident was. When he came home it was apparent that his memory had been impaired. My brother suffers constantly - and both his memory and his mobility have deteriorated over time. He has great difficulty walking."
People can claim for compensation on personal injuries such as those suffered at work, in a traffic accident, as a result of faulty goods or services or errors in hospital treatment.
