Delayed birth boy wins £5 million payout - 06/02/2008[top]

A boy who suffered brain damage after his birth was negligently delayed has received £5.6 million compensation at the High Court in London.

NHS lawyers issued a public apology to Mina and Lakhvinder Kanda and their 10-year-old son Rajan, after it was admitted the emergency caesarean operation needed to deliver the boy resulted in the rupture of Mrs Kanda's uterus and led to disabling brain damage.

Gravesend and North Kent Hospital also paid Ms Kanda a compensation payment seven years ago after she suffered haemorrhage.

Judge Mr Justice Bean said: "Everyone must admire the care which Mr and Mrs Kanda have given to Rajan and will continue to give, I hope, over very many years to come.

"In that respect, at least, Rajan is a very lucky little boy."

"I wish Rajan and his family all the very best for the future."

Although he suffers from dyslexic cerebral palsy, Rajan's intellect has not been affected and he attends a mainstream school.
